Learned counsel for the petitioner submits that the private respondents have raised construction in the plot in question which is undivided land without obtaining sanction from the concerned Panchayat and in violation of the order of status quo granted by this Court. Learned counsel for the private respondents produces copy of the sanctioned plan in respect of the alleged construction. Therefore it is crystal clear that the construction has been raised upon obtaining sanction from the concerned Panchayat. Insofar as the allegation of violation of the order of status quo is concerned, the petitioners are at liberty to approach the appropriate forum for redressal of their grievance. Northing further remains to be dealt with in the writ petition. The same is accordingly disposed of. 2 However, in the event the petitioners seek to challenge the legality and validity of the sanctioned plan granted in favour of the private respondents, they are at liberty to take necessary steps before the appropriate forum. There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted.
