Hence prayed for quashing of the proceeding being GR Case No. 5909 of 2024 arising out of Women Police Station, HPC case no. 64/24 dated 16/11/2024 under Sections 85/115(2)/118(1)/316(2)/351(2)/79/3(5) of BNS pending before the Learned Chief Judicial Magistrate, Howrah. 3. It is submitted by both the learned advocates, after settlement arrived mutual decree of divorce has already been passed by the concerned Court. Report submitted on behalf of the prosecution further disclosed, she got the decree of divorce by mutual consent on 15.05.2026 and written declaration is given by the defacto-complainant mentioning she has no complaint against her husband and other –in-laws and intend to withdraw the complaint which she had lodged. 4. Considering the entire facts and circumstances and this Court is of the view the compromise has been effected between the parties and a decree of mutual divorce is granted by the Court of law and the defacto-complainant has expressed that she has no complaint against the petitioner. There is no scope for 2 further adjudication of the matter as there would be remote possibility of passing any order of conviction after this. 5. Hence the prayer made by way of joint compromise application stands allowed. 6. Accordingly, CRR 1615 of 2026 is hereby disposed of. Entire proceeding pending before the learned Court of Learned Chief Judicial Magistrate, Howrah as stated above stands quashed against the present petitioners. 7.
