Mr. Subir Ganguly ..for the State The petitioner is one of the accused persons in G.R. Case No. 2228 of 2025 arising out of Kalyani Police Station Case No. 717 of 2025 dated July 15, 2025, registered under Section 112(2) of the Bharatiya Nyaya Sanhita, 2023, read with Sections 3 and 4 of the West Bengal Gambling and Prize Competitions Act,1957. Learned counsel appearing for the petitioner seeks expeditious disposal of the trial in view of the mandate contained in Section 529 of the Bharatiya Nagarik Suraksha Sanhita, 2023. It is submitted that, on August 6, 2025, when the matter was taken up for consideration, the learned Additional Chief Judicial Magistrate, Kalyani, Nadia, fixed October 17, 2025 for the appearance of the accused persons and supply of copies. On October 17, 2025, the accused persons appeared before the Court and received copies of the charge-sheet. Thereafter, by an order dated October 18, 2025, the learned Magistrate fixed June 28, 2027 as the next date for appearance. I find considerable substance in the submission advanced on behalf of the petitioner that the learned Magistrate ought not to have adjourned the matter by fixing the next date of appearance nearly two years thereafter. In view of the aforesaid, the order dated October 18, 2025 is set aside. The learned Magistrate in the Court below is directed to fix the next date of the case within one month from the date of communication of this order and to make an endeavour to frame the charge as expeditiously as possible, preferably within one month thereafter. It is further expected that the trial shall be concluded at the earliest, preferably within one year from the date of framing of the charge. Accordingly, CRR 1835 of 2026 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings. (Kausik Chanda, J.) 2
