The petitioner has approached this Court seeking direction to the respondents, as per prayer clause (i) and (ii), which read thus: “i. By an appropriate writ of mandamus, order of direction to respondent no.2 to performed the surgery of the petitioner from the exepnses or funds of the State of Maharshtra or respondendant no. 1 within one months from the date of disposal of present matter, ii. Direct the respondent no. 3 to pay compensation of 15 lakhs to the petitioner for medical negligence, mental and physical health, iii. ...” 3. So far as the prayer clause (i) is concerned, the learned counsel for the petitioner submits that since the petitioner is required to perform surgery for the treatment of cancer, the petitioner has approached this court seeking direction to the respondents to provide the necessary expenses to the petitioner. nd.thawre 2026:BHC-NAG:9532-DB 138 2/2 4. The learned AGP appears for the respondent-State makes a categorical statement that the grievance, as raised by the petitioner, is taken care by respondent No.1-State of Maharashtra under the welfare schemes, more specifically Mahatma Jyotirao Phule Jan Arogya Yojana (MJPJAY) and Ayushman Bharat – Pradhan Mantri Jan Arogya Yojana (AB- PMJAY). 5. Hence, if the petitioner approaches the respondent No.2-Government Medical College and Hospital, Nagpur, with the necessary documents as may be required, the request of the petitioner shall be considered by the respondent No.2 in accordance with law, keeping in view the petitioner’s contention. 6. Insofar as prayer clause (ii) is concerned, the learned counsel for the petitioner seeks leave of this Court to not press the said relief in the present petition and to approach the District Consumer Disputes Redressal Commission by instituting appropriate proceedings for seeking compensation on account of the alleged medical negligence. 7. Permission is granted. 8. In view of the aforesaid statements made by the learned counsel for the petitioner as well as the learned AGP for the respondent-State, nothing survives for consideration in the present petition.
