The petitioner alleges in connection on the part of the respondent CESC Authorities in effecting electricity supply to the petitioner’s residential premises. 2. Learned advocate appearing for the petitioner submits that the petitioner had made an application for new electricity connection sometime in the year 2025. It is submitted that the petitioner has also made the payment in terms of the quotation raised by the CESC Limited yet, electricity supply has not been effected to the petitioner’s residential premises. 3. Learned advocate appearing for the respondent CESC Authorities submits that there are two hindrances in effecting electricity supply in favour of the petitioner. It is submitted that firstly, the 2 petitioner has not filled up and submitted Annexure ‘B’ which is required to be submitted before the respondent CESC Authorities online. It is next submitted that an objection has been raised by the respondent no. 3 to effecting electricity supply to the petitioner’s premises. 4. Learned advocate appearing for the private respondent submits that there is a partition suit going on in between the parties wherein an order directing the parties to maintain status quo as regards nature, character and possession of the property in suit has been passed. 5. Having heard the learned advocates appearing for the respective parties and having considered the material on record that this Court is of the view that if the petitioner is otherwise entitled to electricity, being in settled position of the premises in question, the order directing the parties to maintain status quo as regards nature, character and possession of the suit property would not stand in the way of the petitioner getting electricity supply at the said premises (see Sk Asgar vs. State of West Bengal (2010) 4 CHN Cal 191). 6. The petitioner would however have to comply with the requisite formalities including filing up and submitting annexure ‘B’ in terms of the relevant regulation and paying requisite charges in accordance with law. 3 7. If the petitioner fulfils all the requisite formalities including submission of filled up annexure ‘B’, the respondent CESC Authorities shall effect supply to the petitioner’s premises within two weeks from the date of compliance with all necessary formalities by the petitioner. 8. In case, CESC Authorities face any resistance at the instance of the private respondent i.e. the respondent no. 3 CESC Authorities shall be free to take assistance of the jurisdictional police, costs wherefor will be borne by the petitioner. The officer in charge of the Police Station having jurisdiction over the address of the petitioner as mentioned in the cause title of the writ petition shall render assistance to the electricity authorities in carrying out the works of effecting supply to the petitioner subject the payment of costs by the petitioner for such purpose. 9. With the above observations, WPA 15978 of 2026 stands disposed of. There shall be no order as to costs. 10. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities. (Om Narayan Rai, J.)
