Instant writ petition is preferred by petitioners with following prayer: Action of respondents by which they are not allowing petitioners to continue their posts of college lecturer under Vidya Sambal Yojana in respective college in respective subject may kindly be held illegal and arbitrary. By appropriate writ of direction the respondents may kindly be directed to allow the petitioners to continue on the post of college lecturer under Vidya Sambal Yojana in respective college subject for next academic session 2025-2026/ next academic semester and further academic sessions/semesters and also directed to respondents not to terminate services of petitioners till availability of vacant post in any Govt. College in state of Rajasthan in subject of petitioners. 2. Learned counsel for petitioners while referring order dated 19.09.2025 in D.B. Special Appeal Writ No. 903/2023 titled as “State of Rajasthan & Ors. Vs. Ram Chaturvedi & Anr.” passed by a Division Bench of this Hon’ble Court submits that the case of present petitioners is squarely covered by the controversy [2026:RJ-JP:9149] (3 of 3) [CW-3675/2026] already settled by this Hon'ble Court, based on judgment in case of Manish Gupta & Ors. Vs. President Jan Bhagidari Samiti & Ors., reported in (2022) 15 SCC 540, passed by Hon’ble Supreme Court of India. He also placed reliance upon order dated 06.10.2025 in SB CWP No.13314/2025 Surendra Nagar and Ors. Vs. State of Rajasthan and Ors. 3. Having considered the submission of learned counsel for parties and on perusal of order as placed on record, the present writ petition is disposed of in terms of order dated 19.09.2025 in D.B. Special Appeal Writ No. 903/2023 passed by Hon’ble Division Bench of this Court whereby a guest faculty under the Vidya Sambal Yojna was permitted to continue on said post till availability of regularly selected candidate. 4.
