The second bail application under Section 483 of BNSS is filed by the applicants-accused- Jagveer Singh S/o Samudra Singh, Ranjeet Singh S/o Hargyan seeking bail in respect of a criminal case registered as FIR No. 35/2025 dated 05.05.2025 registered at P.S. Kaithunipol, District – Kota City, for the offence under Sections 189(4), 333, 308(2)(5), 111(2)(b) and 111(4) of BNS. 2. Learned counsel for the applicants submits that the applicants have been falsely implicated in the matter and the investigation against them is complete and they are no more required in investigation. He further submits that there are no chance of fleeing of applicant accused from the jurisdiction of this [2026:RJ-JP:9272] (2 of 4) [CRLMB-3313/2026] Hon’ble Court. He also submits that the applicant undertakes not to repeat offence and cooperate with investigation/trial, which will take time. 3. The first bail application of the present applicants was dismissed by this Hon'ble Court on 11.08.2025 along with co- accused Arjun Singh, but Arjun Singh was released on bail by this Hon'ble Court vide order dated 12.01.2026 and the case of the present applicant is on better footing than Arjun Singh and co- accused Bhupendra Singh @ Chhotu Banna was released on bail by this Court vide order dated 29.01.2026. He further submitted that the main accused was also released on bail by the learned Sessions Judge, whereas two more accused were released by the learned trial court. 4. Learned Public Prosecutor has vehemently opposed the bail application and submitted that the allegations are serious and grave in nature. 5. Heard learned counsel for the petitioner-accused and learned Public Prosecutor. Perused the material placed on record by both the parties. 6. While considering first bail application on 11.08.2025, we have observed as under:- "On the basis of report dated 05.05.2025 lodged by Vinay Goswami Ji Maharaj about unauthorized entry of 8-10 armed persons with Mahendra Puri on 04.05.2025 and intimidation about management and possession of land of temple, FIR No.35/2025 is registered at P.S. Kaithunipole, Kota City. During investigation, police has identified role and involvement of petitioners and other individuals and arrested them. During investigation, police has recovered fire arms from [2026:RJ-JP:9272] (3 of 4) [CRLMB-3313/2026] present petitioners Jagveer Singh and Ranjeet Singh. As per police, these petitioner are members of gang of Shivraj Singh, who is kingpin of organized crime, in Kota region. The police has filed detailed list of 39 members, affiliated to his gang. As per criminal antecedents submitted by police, two criminal cases were registered against Arjun Singh Ranawat. After investigation, police has filed charge-sheet against 10 persons. As per order of trial court, there is no criminal antecedents against Jagveer Singh and Ranjeet Singh but both are not residents of Kota and they were found at Kota on date of incident. There is one criminal antecedents against Bhupendra Singh. Learned Sessions Court has released Mahendra Puri on bail under Section 483 BNSS, who is named in the report and having criminal antecedents. 7. Having taken note of the fact that this Court has allowed the bail application of Arjun Singh on 12.01.2026 and bail application of Bhupendra Singh @ Chhotu Banna on 29.01.2026. The material on record shows that vide order dated 05.12.2025, present accused was discharged from the charge under Section 111(2)(b) and Section 111(4) of BNS. Almost all the accused are now on bail, therefore, it is appropriate to consider the bail application of the present applicant. 8. Upon hearing the arguments and perusing the record, we have found that the applicants-accused are no more required in the investigation and they are in custody for quite some time. The further proceedings will take its own time, therefore, looking to entirety of facts and circumstances of the case and without expressing any opinion on merits of the case, the Court deems it appropriate to grant bail to the applicants-accused. 9. Thus, the second bail application filed on behalf of applicants-accused Jagveer Singh S/o Samudra Singh, and Ranjeet Singh S/o Hargyan is hereby allowed and the [2026:RJ-JP:9272] (4 of 4) [CRLMB-3313/2026] applicants-accused are ordered to be released on bail upon furnishing a personal bond of ₹50,000/- with two sureties of like amount to the satisfaction of the Trial Court with the following conditions:- (i) The applicants-accused shall not tamper with evidence or influence the witness in any manner. (ii) The applicants-accused shall not indulge in any criminal activity and shall not repeat any criminal offence punishable under the Law. (iii) The applicants-accused shall attend the hearing of the Trial Court on the date fixed by the Trial court or as and when asked to appear before the Trial Court. (iv) In case of any violation of above conditions, the bail granted to the applicant-accused shall be liable to be canceled. 10.
