The petitioner has filed this writ petition seeking following reliefs:- “10.1 That, this Hon'ble Court may kindly be pleased to call for entire records of petitioner from Respondent No. 2 & 3. 10.2 That, this Hon'ble Court may kindly be pleased to pass any appropriate writ/order directing the Respondents No. 2 & 3 to give promotion benefit 2 of Class III with effect from year 2008 when the junior i.e. ‘Sharad Kumar Vishwas’ got promoted i.e. on 20.06.2008 for Class III post. 10.3 That, this Hon'ble Court may kindly be pleased to pass any appropriate writ/order to the respondent (s) for giving promotion to the post of 'Sub Engineer' with effect from year, 2013 and with all consequential benefits. 10.4 That, this Hon’ble Court may kindly be pleased to pass any appropriate writ/order for giving seniority with effect 2013 where the similarly situated employees have been promoted. 10.5 That, this Hon’ble Court may kindly be pleased to pass any appropriate writ/order directing respondent no. 2 and 3 to pass reason and speaking order for considering petitioner's pending representation dated 31/01/2022 (Annexure P/6) as per promotion rules governing the field. 10.6 That, this Hon’ble Court may kindly be pleased to pass any appropriate writ/order directing respondent no. 2 and 3 to pass reason and speaking order for considering petitioner's pending representation dated 31/01/2022 (Annexure P/6) as per promotion rules governing the field.” 2. Learned counsel for the petitioner submits that he is not pressing this writ petition on merits and is only seeking a direction to the Respondent No. 3 to take decision on the pending representation dated 31.01.2022. He further submits that he will file afresh representation before the Respondents No. 2 & 3 and therefore, direction be issued to the Respondents No 2 & 3 to take decision on the representation to be submitted by the petitioner at the earliest, within specified time. 3. On the other hand, learned counsel for the Respondents No. 3 to 8 would submit that as the petitioner is not pressing this writ petition on merits and is only seeking a direction to the concerned authorities to take decision on the pending representation, he is having no objection to the limited prayer. However, if representation is pending consideration, it will be considered in accordance with law. 4. I have heard learned counsel for the parties and perused the documents placed on record. 3 5. On due consideration of the submission of counsel for the respective parties, facts and circumstances of the case, nature of grievance raised by the petitioner, without entering into the merits of the claim of petitioner, this writ petition at this stage is disposed of permitting the petitioner to submit afresh representation before the Respondents No. 2 & 3 and if such a representation is submitted by the petitioner, Respondents No. 2 & 3 are directed to take decision on the representation of the petitioner on its own merits, in accordance with law, expeditiously, preferably within a period of 04 months from the date of receipt of order. 6.
