J. (Oral) The petition under Section 226/227 of Constitution of India seeks following reliefs: (i) direction to respondents No. 2 to 4 to protect life and liberty of the petitioner from private respondent No. 5; (ii) direction to respondents No. 2 and 3 to consider and decide representation dated 03.06.2026 (Annexure P-2).
Learned counsel for the petitioner submits that petitioner was a 75 years old lady. Her grandson namely Gurwinder Singh, who was owner of immovable property, was murdered by unknown persons on 28.01.2026, regarding which FIR was registered in police Station, Sohana. Petitioner’s grandson was unmarried. After his death, respondent No. 5, claiming herself to be wife of Gurwinder Singh, in order to grab his property, tried to get mutation entered in her name on the basis of forged and fabricated documents. Civil dispute regarding property of Gurwinder Singh was pending in the Court at Kharar. On 02.06.2026, respondent No. 5 along with some unknown persons came to house of the petitioner and raised Lalkara to kill her. Soon thereafter, on 03.06.2026, petitioner moved a representation to respondent No. 2 for protection of her life and liberty but no action was taken thereon. CRWP-8013-2026 (O&M) -2- this stage, petitioner would be satisfied if appropriate direction is issued to the respondent No. 2- Senior Superintendent of Police, SAS Nagar(Mohali), to consider and decide representation dated 03.06.2026 (Annexure P-2) moved by petitioner and take necessary action thereupon in a time bound manner. Notice of motion to official respondents only. Mr. Kunwarbir Singh, AAG Punjab, who is present in Court, accepts notice on behalf of the official respondents and on instructions from ASI Jasmer Singh submits that similar representation was moved by respondent No. 5 as well and process on both the representations was underway. The parties were called to the police station but none appeared. He further submits that the representations would be decided in due course. Keeping in view the limited prayer made by petitioner, the present petition is disposed of with a direction to respondent No. 2- Senior Superintendent of Police, SAS Nagar (Mohali), to decide the aforesaid representation dated 03.06.2026 (Annexure P-2) submitted by petitioner within a period of one month from today by passing a reasoned and speaking order in accordance with law and take necessary action, if so required. However, if, respondent No.2 does not find any substance in the allegations levelled in the representation (Annexure P-2), the petitioner shall be informed as per mandate of law. Pending CRM(s), if any, are also disposed of accordingly.
