Mr. Pritam Roy. …for the State. Learned advocate appearing for the petitioner submits that the subject matter of recovery in the present case is 50 bottles of fair deal. Other accused persons have been granted bail. Petitioner is in custody for 100 days, charge-sheet has been submitted and charges have been framed. Learned advocate for the State opposes the prayer for bail in view of the quantum of contraband seized. Having considered that the prosecution intends to rely upon 14 witnesses in order to prove its case and memo of evidence do not reflect any criminal antecedent of the present petitioner, I am inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is allowed. The petitioner, namely, Rubel Mondal @ Mandal shall be released on bail upon furnishing bond of 2 Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, under NDPS Act, 3rd Court, Balurghat, Dakshin Dinajpur. If on bail, the petitioner shall be physically present on each and every date before the learned trial court and shall not leave the district of Dakshin Dinajpur without the prior permission of the learned special court. Thus, CRM(NDPS) 1191 of 2026 is allowed. Memo of Evidence submitted by the State be kept with the record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
