1. Heard the parties. 2. It is the grievance of the petitioners who happens to be the sisters of the deceased -Usha Kumari who was an Assistant Teacher in Girls High School, Hunterganj, Chatra, that they have not been paid the death benefits of Usha Kumari, as there are the nominees. 3. It is the case of the petitioners that Usha Kumari who was the Assistant Teacher in Girls High School, Hunterganj, Chatra, died on 05.04.2020. Her husband pre-deceased her. The deceased did not have any issue, thus had nominated these two petitioners, namely, Jayanti Singh, W/o Nageshwar Kumar Vidyarthi and Sandhya Kumari, W/o Nawal Singh who are her sisters to receive all the benefits, but the respondents have not disbursed the same. In support of the contention, the counsel for the petitioner refers

to Annexure-1 which is the pension papers, which suggests that these two petitioners were nominated to receive the amount in the event of death of the employee. 4. Considering the said submission, I direct the District Education Officer, Chatra to ensure that the death benefit which had accrued after death of Usha Kumari, Assistant Teacher, Girls High School, Hunterganj, Chatra is disbursed to the persons who has been nominated by her to receive the same.
If there is no nomination in the records, appropriate succession certificate will be produced by the persons who are claiming the amount. 5. The petitioners are directed to file a representation within four weeks before respondent No.4. On receipt of the said representation, the case of the petitioners will be considered within eight weeks. 6. With the aforesaid observations, this writ petition stands disposed of. (ANANDA SEN, J.)
