Ajay Singh Mr. Samrat Choudhury, Mr. Sayan Ray …for the petitioner In this application, the petitioner is very much aggrieved with the inordinate delay caused in disposal of the proceeding being Complaint Case No.C-141 of 2015, presently pending before learned Judicial Magistrate, 3rd Court, Alipore. Being aggrieved by the inordinate delay in disposal of the proceeding, learned Counsel for the petitioner/complainant submits that the said complaint case was lodged by the petitioner in the month of January, 2015. Thereafter evidence on behalf of the complainant as P.W.1 was adduced on 29th July, 2022. Since then, the trial did not proceed for last four years in spite of specific direction passed by this Court thrice. Therefore, he prayed for further direction upon the Court below for expeditious disposal of the proceeding. Having heard learned Counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made in the application, the opposite party will have no cause to prejudice and, as such, the service of copy of application upon the opposite party is dispensed with. 2 Having considered submission made on behalf of the petitioner and that the trial of the said complaint case being C Case No.141 of 2015 has got stalled for about four years and also considering the fact that this Court vide order dated 09.09.2016 passed in CRR 3004 of 2016 and thereafter vide order dated 17.02.2022 passed in CRR 2292 of 2021 and lastly by another order dated 3rd December, 2025 passed in CRR 5163 of 2025 made specific direction for expeditious disposal of the said proceeding but learned Court below has not made any endeavour to conclude the trial expeditiously as directed by this Court, I find that the prayer made by the petitioner is justified and required to be allowed to secure the ends of justice. In view of above, the instant application being CRR 2708 of 2026 is hereby disposed of with a direction upon the Court below to make every endeavour for expeditious disposal of the said proceeding being Complaint Case No.141 of 2015 presently pending before learned Judicial Magistrate, 3rd Court, Alipore and to conclude the entire proceeding positively within a period of 3 months from the next date of hearing.
