JUSTICE D K SINGH) The present writ appeal has been filed against the order dated 13.10.2025 passed by the writ Court in W.P.No.13177/2021 filed by the appellant challenging the notice dated 28.06.2021 issued by the Chief Manager, Central - 3 - HC-KAR CNR: KAHC010852132025 NC: 2026:KHC:36063-DB WA No. 2151 of 2025 Bank of India, Bengaluru directing her to report on duty within 30 days of notice, failing which, it would be treated that the appellant/petitioner has voluntarily vacated her appointment/employment in the Central Bank of India. 2. During the course of hearing, learned counsel appearing for the appellant submitted that the appellant was willing to report for duty in the place of posting where she was transferred i.e., Regional Office, Vijayawada. In view of the said submission, this Court on 22.04.2026 passed the following order: "Learned counsel for the respondent Bank submits that the appellant has been transferred to Regional Office, Vijayawada. The appellant is permitted to join the Regional Office, Vijayawada by 27.04.2026 as per the transfer order, which though has not been produced but the Court is informed that the appellant stand transferred to Vijayawada. The appellant shall be paid full salary after she joins the services on 27.04.2026. In case of failure of the appellant to report for duty at Regional Office, Vijayawada on 27.04.2026, the - 4 - HC-KAR CNR: KAHC010852132025 NC: 2026:KHC:36063-DB WA No. 2151 of 2025 appellant shall not be entitled to join the services till the disciplinary proceedings contemplated against her are culminated in the final order. The respondent Bank is directed to allow the appellant to join the Regional Office, Vijayawada as on her reporting on 27.04.2026." 3. Today, the learned counsel for the appellant submits that the appellant/petitioner does not wish to join the Regional Office, Vijayawada in compliance of the order dated 22.04.2026. 4. We find no reason to interfere with the order passed by the learned Single Judge. The appellant has misled this Court that she was willing to join the transfer post at Vijayawada and in fact violated the order dated 22.04.2026 which was passed on her undertaking that she would go and join the Regional Office at Vijayawada. 5. We, therefore, find no infirmity or illegality in the judgment and order passed by the learned Single Judge and therefore, the writ appeal stands dismissed. - 5 - HC-KAR CNR: KAHC010852132025 NC: 2026:KHC:36063-DB WA No. 2151 of 2025 6.
