At the time of hearing, learned advocate appearing on behalf of the writ petitioner candidly submits before this Court that he is not sure whether the alleged unauthorised encroachment at the instance of the private respondent nos. 9 to 11 has been done on PWD land or in the Government land. 2. Such being the position, this Court is of the considered view that since the carriage of proceeding is with the writ petitioner and since the writ petitioner is 2 not sure as to where the alleged unauthorised encroachment is made, this Court considers that it is a fit case for dismissal of the instant writ petition. 3. With the aforementioned observations, WPA 13812 of 2026 is dismissed. 4. Liberty is given to the writ petitioner to approach this Court by filing similar such petition on the self-same cause of action with appropriate instruction, if so advised. 5.
