Vishl Kumar Mr. Sanjib Das … for the State-respondent(s) Learned advocate for the petitioners submits that the petitioners are in custody for one year eleven months; charge-sheet has been submitted; charges have been framed but some time will be required to take the trial to its logical conclusion. Learned advocate, as such, prays that the petitioners may be released on bail. Learned advocate for the State opposes the prayer for bail. It has also been contended, on a query from this court, that there are no criminal antecedents of the present petitioners. Having considered the period of detention of the present petitioners and the fact that some time will be 2 required to take the trial to its logical conclusion, I am inclined to enlarge the petitioners on bail. Hence, the prayer for bail of the petitioners is Allowed. Accordingly, the petitioners viz, Bijoy Karketta and Niko Munda shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only)each, with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned Judge, Special Court (NDPS Act), 3rd Court, Howrah. If on bail, the petitioner shall also make themselves physically available on each and every date so fixed by the learned Special court/trial court and shall not leave the district of Howrah without prior permission of the learned Special Court/trial court. Accordingly, CRM (NDPS) 1027 of 2026 is allowed. Memo of Evidence submitted be kept with the record.
