The instant petition has been filed by the petitioners for directions to the respondents No.2 to transfer and conduct fair and impartial investigation in a case arising out of FIR No.125 dated 29.05.2026, under Sections 308(2) & 61(2) [Section 249 added later on] of Bharatiya Nyaya Sanhita, 2023 & Sections 25, 27 of the Arms Act, 1959, Police Station City Batala, Police District Batala, District Gurdaspur. 2. The learned counsel representing the petitioners submits that the petitioners have filed a representation dated 01.07.2026 (Annexure P-6) before the respondent No.2-Director General of Police, Punjab. The learned counsel prays for directions to the respondent No.2 to decide the above mentioned representation within the stipulated time frame. Since advance notice has already been served upon the State, Mr. Eklavya Darshi, Deputy Advocate General, Punjab, accepts notice on behalf of respondents-State. Hence, the service of notice upon the State is hereby dispensed with. 4. Learned counsel for the petitioners submits that a direction for deciding the representation of the petitioners (Annexure P-6) be given to the respondent No.2, and that the instant petition be disposed of accordingly. 5. Keeping in view the aforesaid facts, the present petition is hereby disposed of with a direction to the respondent No.2 to decide the representation of the petitioners (Annexure P-6), by passing a speaking order within a period of two months from the date of receipt of copy of instant order. It is however clarified that no finding is being returned by this Court, with regard to merits of the contents of representation. The respondent No.2 shall be at liberty to make an independent assessment with regard to contents of representation of the petitioners, and take an independent decision at his own level.
