IN THE HIGH COURT OF ORISSA AT CUTTACK ABLAPL No.8281 of 2026 Sanurjya Gouda …. Petitioner Mr. A. Das, Advocate -versus- State of Odisha …. Opposite Party Mr. C.R. Swain, AGA CORAM: JUSTICE V. NARASINGH Order No. ORDER 24.07.2026 01. 1. Heard learned counsel for the Petitioner and learned counsel for the State. 2. The Petitioner is seeking pre-arrest bail in connection with G.R. Case No.98 of 2026 pending on the file of learned JMFC (Rural) Cog. Berhampur, Ganjam, arising out of Golanthara P.S. Case No.30 of 2026 for commission of offences punishable under Sections 109,115(2), 118(1), 126(2), 3(5), 303(2) & 351(2) of The BNS, 2023. 3. It is submitted by the learned counsel that the Petitioner was directed to be released on bail by order 21.04.2026 in ABLAPL No.2274 of 2026 after taking into account the injury report of the Bhabagrahi Gouda @ Kanha Gouda. 4. It is further submitted that since the Petitioner has two criminal antecedents, the present application has been preferred. Referring to the said criminal antecedent, it is stated that taking into account the nature of criminal antecedent not being of similar nature, the same ought not to deter this Court considering the bail application afresh. Hence, the Petitioner may be protected by pre-arrest bail. 5. Learned counsel for the State opposes the prayer for pre-arrest bail. 6. Considering the background in which the allegation has been levelled, the nature of criminal antecedent and filing of charge sheet, it is directed that on surrendering within three weeks hence and moving for bail, the Petitioner shall be released on bail by the learned Court in seisin on such terms as deemed just and proper. 7. It is further stated that the Petitioner shall cooperate with the ongoing investigation. 8. Accordingly, the ABLAPL stands disposed of. U.C.C. as per rules. (V. NARASINGH) Judge Soumya
