For Petitioner : Mr.J.Anandkumar For R1 & R2 : Mr.K.Saravanan Government Advocate For R3 : Mr.Arun Arockiasamy Government Advocate (crl.side) ORDER Seeking to direct the respondents 1 to 3 to take necessary action against the excommunication of the petitioner and his family members by considering the representation of the petitioner, dated 18.05.2026 and further to direct the respondents 1 to 3 to permit the petitioner to participate in the festival of Arulmigu Sri Pidari Amman, Sri Periakaruppar, Sri Chinnakaruppar, Sri Kombukkaran, Sri Sannasi and Sri Kizhavan at K.Siruvanur village, this writ petition is filed. 2. The learned counsel for the petitioner submitted that the respondents 4 to 11 have excommunicated the petitioner and his family members from participating the aforesaid temple festival and also from the entire community and hence, this writ petition. 4. The learned Government Advocate appearing for the 1st and 2nd respondents submitted that no act of excommunication is identified in the locality. He further submitted that it is not a case of excommunication, but is a dispute regarding poojariship. 5. The learned Government Advocate(Crl.side) appearing for the 3rd respondent submitted that it would be seen that no one is excommunicated from the locality. 6. Heard the learned counsel on either side and carefully perused the materials available on record. 7. The 3rd respondent is directed to put the petitioner as well as the respondents 4 to 11 on notice under Section 64 BNSS forthwith and thereafter, 3/6 https://www.mhc.tn.gov.in/judis W.P.Crl.(MD)No.2925 of 2026 conclude the enquiry on or before 04.06.2026 and make sure that the petitioner or anyone in the locality should not be prevented from participating in the said temple festival. It is also made clear that excommunication of any person should be strictly monitored. Since the learned Government Advocate appearing for the 1st and 2nd respondents pointed out that it is not a dispute about excommunication, but about the question of poojariship, it is made clear that the petitioner will be permitted to participate in the functions, leaving open the question of poojariship. 8.
