QUASH BY ISSUANCE OF WRIT IN THE NATURE OF CERTIORARI THE IMPUGNED REJECTION OF THE PETITIONERS APPLICATION FOR ALLOTMENT OF LAND AS DISPLAYED ON THE WEBSITE OF THE 2ND RESPONDENT, PRODUCED AS ANNEXURE-F, DATED 24.09.2024 PASSED BY THE 3RD RESPONDENT AS BEING ARBITRARY, DISCRIMINATORY, AND VIOLATIVE OF ARTICLES 14 AND 21 OF THE CONSTITUTION OF INDIA AND ETC., THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. The petitioner is before this Court seeking for the following reliefs: “Wherefore, the Petitioner most humbly prays that this Hon'ble Court may be pleased to: i. Quash by issuance of Writ in the nature of Certiorari the impugned rejection of the Petitioner's - 3 - HC-KAR NC: 2026:KHC:35667 WP No. 26615 of 2025 application for allotment of land as displayed on the website of the 2nd Respondent, produced as Annexure-F dated 24/9/2024 passed by the 3rd Respondent as being arbitrary, discriminatory, and violative of Articles 14 and 21 of the Constitution of India; ii. Issue a writ of mandamus or any other appropriate writ, order or direction, directing the 2nd and 3rd Respondents to forthwith consider and allot the land to the Petitioner in terms of the approval already granted by the 1st Respondent under the District Level Single Window Sanction Committee meeting held on 27/02/2024; and communicated to the Petitioner through letter dated 11/03/2024, vide Annexure-B, by considering the representation dated 25/08/2025 vide Annexure-G. iii. Direct the Respondents to reconsider the application of the Petitioner afresh, in accordance with law, by assigning due reasons, and to allot the land to the Petitioner within a time frame fixed by this Hon'ble Court; as per representation dated 25/8/2025 at Annexure-G addressed to the 2nd and 3rd Respondents. iv. Pass such other order or direction as this Hon'ble Court may deem fit in the interest of justice and equity.” 2. The submission of learned counsel for the petitioner, earlier as also today is that, the petitioner's grievance would be redressed, if prayer at Roman No.ii is granted. - 4 - HC-KAR NC: 2026:KHC:35667 WP No. 26615 of 2025 3. Sri Gopal B.V., learned counsel for respondent Nos.2 and 3 would submit that the representation of the petitioner dated 25.08.2025 in pursuance of the approval granted by a District Level Single Window Sanction Committee held on 27.02.2024 communicated on 11.03.2024 is still to be considered by the respondents. 4. Whenever any approval is granted by the concerned Authority or other Authorities is required to act on the same or required to do so with alacrity as early as possible. 5. In the present case, the approval of the project has been made on 27.02.2024, but till today, no action has been taken. The petitioner had submitted representation on 25.08.2025, which has also not been acted upon by the respondents till date. It reflects poorly on respondent Nos.2 and 3. - 5 - HC-KAR NC: 2026:KHC:35667 WP No. 26615 of 2025 6. In that view of the matter, this Court passes the following ORDER (i) The writ petition is allowed. (ii) The respondents are directed to consider and pass necessary orders on the representation of the petitioner dated 25.08.2025 at Annexure-G within a period of four weeks from the date of receipt of copy of this order.
