Affidavit of service is taken on record. Service report indicates that the respondent has been duly served. The present application has been filed under Section 15(2) read with Section 11(6) of the Arbitration and Conciliation Act, 1996. Learned counsel for the petitioner submits that this Court vide order dated 4thNovember, 2022 passed in AP 528 of 2022 had appointed Hon’ble Justice Om Narayan Rai, then an advocate of this Court, as the learned Sole Arbitrator to resolve the disputes between the parties. It is submitted that the said learned Arbitrator has since been elevated as a Judge of this Court and in view of the same, the mandate of the learned arbitral tribunal has ceased. 2 Accordingly, the present application has been filed seeking substitution of the appointment of the learned Arbitrator. In view of the said development, the learned Arbitrator is substituted by Mr. Jayanta Sengupta (Mob. No. 9231500518) who is appointed as a Sole Arbitrator to adjudicate the disputes between the parties. The substituted arbitrator shall assume charge of the arbitral proceedings and continue the same from the stage at which they stood immediately prior to such substitution. The learned Sole Arbitrator shall enter reference in due compliance with Section 12(5) of the Act. The learned Sole Arbitrator shall fix his remuneration in terms of the fourth schedule of the Act. A copy this order shall be communicated to the learned Sole Arbitrator to take necessary steps. With the aforesaid directions, the present application stands disposed of. (GAURANG KANTH, J.) R. D.
