ORDER : The Court made the following order :- The petitioner / A1, who was arrested and remanded to judicial custody on 26.02.2026 for the offences punishable under Sections 103(1) and 311 of BNS, 2023 @ 103(1), 190, 191(2), 310(3), 311, 49 and 61(2) of BNS, 2023, in Crime No.75 of 2026 on the file of the respondent police, seeks bail. 2.The case of the prosecution is that the accused persons and the deceased were relatives and the deceased is the father of the defacto complainant. On 19.02.2026, the petitioner and other accused persons were staying in the cottage at Kodaikanal. No.8708 of 2026 Thereafter, they have tied the deceased in the cottage, murdered him and looted 2 sovereigns of gold chain and 1½ sovereigns of gold ring and escaped from the scene of occurrence. Hence, the complaint. 3. The learned counsel appearing for the petitioner would submit that the respondent Police registered a case against the petitioner and others. He would further submit that the petitioner is an innocent person and he has been falsely implicated in this case. He would further submit that co-accused were arrested and released on bail. The petitioner has been arrested and remanded to judicial custody on 26.02.2026. Hence, he prays to grant bail to the petitioner. 4. The learned Government Advocate (Crl. CRL OP(MD). No.8708 of 2026 offences are grave in nature. He would further submit that A3 is absconding. He would further submit that the petitioner has no previous cases. However, he strongly opposed to grant bail to the petitioner. 5. This Court heard both sides and perused the materials available on record. 6. Considering the rival submissions made by the learned counsel on either side, nature of offence, and the petitioner has no previous cases and except A3, all other accused were arrested and released on bail and the material part of the investigation might have been completed and also considering the period of incarceration undergone by the petitioner from 26.02.2026, this Court is inclined to grant bail to the petitioner subject to the following conditions: 4/8 https://www.mhc.tn.gov.in/judis

No.8708 of 2026 [a] Accordingly, the petitioner is ordered to be released on bail on condition to execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.II, Kodaikanal, Dindigul District, and on further conditions that: [b] the petitioner shall report before the respondent Police daily at 10.30 a.m., until further orders.
