ORAL ORDER
1. Accused No.1 in SC No.22/2024 pending before the Court of I Additional District and Sessions Judge, Mysuru, arising out of Crime No.65/2022 registered by Metagalli Police Station, Mysuru, for the offences punishable under Sections 395 and 397 of IPC, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail.
2. Heard the learned counsel for the parties.

Learned counsel for the petitioner submits that petitioner was arrested in the present case during the course of investigation on 20.04.2022 and subsequently, he was released on regular bail by the jurisdictional Sessions Court in Crl.Misc.No.965/2022. After the case was committed to the Sessions Court, petitioner had not appeared before the Trial Court on regular dates of hearing and therefore, he is now taken into custody on 10.03.2026. He submits that petitioner has no other criminal antecedents and is ready to abide by the conditions that may be imposed on him. Accordingly, he prays to allow the petition. - 3 -

4. Per contra, learned Addl. SPP, who has opposed the petition does not dispute the submission made by learned counsel for the petitioner. She, however, submits that petitioner has remained absent before the Trial Court for a considerable period of time. Accordingly, she prays to dismiss the petition. 5. Perusal of the material on record would go to show that petitioner, who was arrested in the present case on 20.04.2022 during the course of investigation, was subsequently enlarged on bail by the jurisdictional Sessions Court in Crl.Misc.No.965/2022. After the charge sheet was filed in the present case, case was committed to the jurisdictional Court of Sessions Judge and numbered in SC No.22/2024. In the said case, petitioner was granted regular bail by the Trial Court on
23.08.2024. It appears that subsequently petitioner had remained absent before the Trial Court and on 12.11.2024, NBW was issued against him. Subsequently, his presence was secured on 10.03.2026 and on the said day, he was remanded to judicial custody. It is not in dispute that petitioner has no other criminal antecedents. On the merits of the case, he was

earlier granted regular bail and only for the reason that he had not appeared before the Trial Court on the regular dates of hearing, he is now remanded to judicial custody on 10.03.2026. For the mistake committed by the petitioner by not appearing before the Trial Court on the regular dates of hearing, he has been sufficiently punished. He has undertaken to abide by the conditions that may be imposed on him. Accordingly, the following order:-
6. The petition is allowed.
The petitioner is directed to be enlarged on bail in SC No.22/2024 pending before the Court of I Additional District and Sessions Judge, Mysuru, arising out of Crime No.65/2022 registered by Metagalli Police Station, Mysuru, for the offences punishable under Sections 395 and 397 of IPC, subject to the following conditions:
a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court;
b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the

Trial Court exempts his appearance for valid reasons;
c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;
d) The petitioner shall not involve in similar offences in future;
e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is
disposed off.
