Prayer in the present petition preferred under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short the ‘BNSS’) is for the grant of anticipatory bail to the petitioner in case FIR No.52 dated 27.03.2026 registered under Sections 22 NDPS Act, 1985 (Section 29 of NDPS later on added), at Police Station Hathur, District Ludhiana.
2. On 05.06.2026, the following order was passed by a Coordinate Bench:-
“Learned counsel for the petitioner has inter alia argued that on 27.03.2026, in the area of the police station in question, co-accused Harnarinder Singh @ Honey of the petitioner was found in conscious possession of 15 loose intoxicant tablets of white colour in violation of the provisions of the NDPS Act; that on his arrest in the matter in question, he is alleged to have made PRIYANKA 2026.07.10 17:34 I attest to the accuracy and integrity of this document
CRM-M-32931-2026 -2- a disclosure statement that the petitioner, in fact, had sold the al- leged contraband to him; that the petitioner never sold the same to him and has been falsely named by him as well as the police in the case in question; that disclosure statement of a co-accused made in police custody is always a weak type of evidence not sufficient for recording the conviction atleast; that the petitioner is resident of District Ludhiana in Punjab and is ready to join investigation with the concerned Investigating Officer; that no incriminating article was recovered from the petitioner; and that the petitioner is on bail in the cases mentioned in the petition. Notice of motion. Ms. Samdisha Kaur, AAG, Punjab, accepts notice on behalf of the State of Punjab. She argues that there are two more cases under the NDPS Act registered against the petitioner in the State of Rajasthan and she may be granted time to collect information about the said cases. At her request and in the interest of justice, adjourned to
10.07.2026. However, without commenting anything upon merits of the FIR/matter in question but considering the arguments of the
learned counsel for the petitioner and the totality of the
facts/circumstances of the present case, the petitioner is directed to join investigation of the case/FIR in question with the concerned investigating officer within seven days from today. It is also ordered that in the event of his arrest in the FIR in question, he shall be released on interim bail to the satisfaction of such officer. However, on such bail, he shall comply with the term/s and condition/s contained in Section 480(3) and 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023”

Learned counsel representing the State of Punjab, on instructions from ASI Sulakhan Singh, Police Station Hathur, District Ludhiana (Rural) who is present in the Court, submits that in compliance of the order dated 05.06.2026, the petitioner has duly joined investigation and his custodial interrogation is not required.
5. In view of the fact that the petitioner has duly joined investigation and keeping in view the statement given by learned counsel representing the State of Punjab, the present petition is allowed. The order dated 05.06.2026 is made absolute, subject to compliance of the provisions as envisaged under Section 482(2) of the BNSS.
