The petitioner is apprehending his arrest in connection with Mayurhand P.S. Case No.73 of 2025, for offence registered under section 303(2), 317(5) of BNS, 2023, Section 21 of Mines and Mineals (Development and Regulation) Act, 1957, Rules 4/54 of Jharkhand Minor Minerals Concessions Rules and Rule 13 of Jharkhand Minerals (Prevention of Illegal Mining, Transportation and Storage) Rules, pending in court of learned Judicial Magistrate First Class, Chatra.

Learned counsel for the petitioner submits that the petitioner happened to be driver of the tractor and the allegations are made that 100 cft sand was loaded on the said tractor and the petitioner is having no criminal antecedent as disclosed in paragraph no.10 of the petition. He next submits that the owner of

the tractor has been granted anticipatory bail in ABA No.1276 of
2026.

Learned counsel for the State submits that illegally the sand in question was being carried.

Considering that the petitioner is driver and the allegations are made of carrying 100 cft sand on the tractor and the petitioner is having no criminal antecedent as aforesaid and in course of the argument it has been pointed out that the petitioner is earning his livelihood by driving the tractor, and in that view of the matter, the petitioner, above named, is directed to surrender before learned court within two weeks from today and learned court shall release the petitioner, above named, on such terms and conditions as well as sureties as learned court may deem fit and proper.
6. A.B.A. No.1331 of 2026 is disposed of.
