Rakib (Allowed) CRM (M) 2843 of 2025 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Tamluk Police Station case no. 188 of 2025 dated 08.03.2025 under Sections 420/406/464/465/467/468/471/409 of the Indian Penal Code. And In the matter of : Ashok Samanta ……Petitioner. Mr. Milon Mukherjee, Sr. Adv, Mr. Satadru Lahiri Mr. L. Bhattacharyya .....for the Petitioner. Mr. Rajendra Banerjee, Ld. APP Mr. Suman Chakraborty ……for the State. Learned senior advocate appearing for the petitioner submits that the petitioner is in custody for one year two months and charges have already been framed. Additionally, three witnesses have been examined out of the cited 18 witnesses. Learned advocate appearing for the State opposes the prayer for bail. Records speaks that the trial is continuing before the learned Judicial Magistrate, 3rd Court, Tamluk. Having considered that presently the offences are tried as a Magistrate triable case, I am inclined to release the petitioner on bail without entering into the merits of the case. Accordingly, the prayer for bail of the petitioner is allowed. 2 As such, the petitioner, namely, Ashok Samanta shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Judicial Magistrate, 3rd Court, Tamluk, Purba Medinipur. If on bail, the petitioner shall be physically present on each and every date before the learned Trial Court and shall not leave the jurisdiction of Tamluk Police Station without prior permission of the learned Trial Court. Thus, CRM (M) No. 2843 of 2025 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
