The Petitioners are seeking pre-arrest bail in connection with C.T. Case No.1668 of 2026 pending on the file of learned J.M.F.C.-II, Bhubaneswar, arising out of Chandrasekharpur P.S. Case No.662 of 2026 for commission of offences punishable under Sections 126(2), 296(b), 115(2), 351(3), 85, 75(2), 3(5) of BNS, 2023 read with Section 4 of the D.P. Act, 1961. 3. At the outset, learned counsel for the State, on instructions, submits that the Investigating Agency has taken recourse to the provision contained under Section 35(3) of BNSS in respect of the Petitioner No.1(Manoj Kumar Patra). As such, there is no apprehension of arrest and the ABLAPL is confined to the Petitioner No.2 (Roshni Patra). As such no order need be passed in respect of the Petitioner No.1(Manoj Kumar Patra). 4. It is submitted by the learned counsel that the Petitioner No.2 is the sister-in-law of the husband, she has been roped in as an accused and it is stated she is in the family way. 5. Considering the role ascribed to the Petitioner No.2(Roshni Patra) and that the husband taken into custody and release on bail, it is directed that in the event of arrest of the Petitioner No.2(Roshni Patra) in connection with the aforesaid case, she shall be released on bail by the Arresting Officer on such terms and conditions deemed just and proper with further conditions that she will cooperate with the investigation. 6. Accordingly, the ABLAPL stands disposed of. U.C.C. as per rules. (V.
