The petitioner applied for transfer on the ground of his child’s health issues. The child of the petitioner is suffering from Autism Spectrum Disorder. 2. The application of the petitioner was filed in the Utshashree portal and the same is pending consideration before the school authority for a considerable period of time. 3. As enough time has expired from the date of filing the application seeking transfer and there may have been change in the circumstances seeking transfer, accordingly, the instant writ petition stands disposed of with the observation that it will be open for the petitioner to make fresh online application seeking transfer disclosing the ground for the same. Page 2 4. If the online portal is non-functional, then application seeking transfer may be filed offline in the prescribed format. 5. In the event such an application is made, the same shall be considered by the head of the institution in accordance with the prevailing rules and in line with the decisions laid down by this Court in WPA 15447 of 2025 (Beauti Baitha Vs. The State of West Bengal & Ors.); WPA 20742 of 2023 (Saurav Basu Vs. The State of West Bengal & Ors.); WPA 9141 of 2025 (Swati Pal Vs. The State of West Bengal & Ors.) and WPA 26829 of 2024 (Sunita Nandan Vs. The State of West Bengal & Ors.). 6. Steps shall be taken in the matter at the earliest but positively within a period of eight weeks from the date of receipt of the application from the petitioner. 7. The fate of the petitioner’s application shall be made known to the petitioner. 8. If the application of the petitioner is allowed, then necessary consequential steps shall be taken without any further delay. 9. Be it recorded that exclusion of the medical condition (Autism Spectrum Disorder) in the list of benchmark disabilities will not stand in the way of the respondent in considering the petitioner’s application for transfer. 10. Suspension of the Utsashree portal will not stand in the way of the respondents to consider the application for transfer made by the petitioner. 11. The writ petition stands disposed of. 12.
