The instant application has been filed under Sections 483 and 484 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of bail in connection with Barkagaon P.S. Case No.65 of 2024 registered under Sections 147, 148, 149, 353, 307 IPC; Section 25(1-B)a/25(1A)/26/27/35 of the Arms Act; and Section 17 CLA Act, pending in the court of learned Addl. Sessions Judge, VIII, Hazaribag. 2. Learned counsel for the petitioner has submitted that he has been implicated in this case and his name has come on the confessional statement of co-accused person, namely, Suraj Bhuiyan, Vipin Lohra and Arjun Ganjhu of Barkagaon P.S. Case No. 60 of 23024, which has got no evidentiary value in the eye of law. 3. It has been submitted that the other co-accused person, namely, Badal Ganjhu @ Badal Bhogta @ Bhumar @ 2026:JHHC:9198 Page | 2 Vishal Ji; Ajit Soren have already been granted bail by the co-ordinate Bench of this Court in B.A. No. 1305 of 2025 dated 04.08.2025 and B.A. No. 2399 of 2025 dated18.08.2025 respectively and the case of the present petitioner falls on same footing. The petitioner is in custody since July, 2025. 4. Therefore, claiming the ground of parity, submission has been made that the present petitioner may be enlarged on bail. 5. Learned Additional Public Prosecutor appearing for the opposite party-State although has seriously opposed the prayer for grant of bail but he has not disputed the fact of grant of bail in favour of the co-accused persons. 6. This Court has heard the learned counsel for the parties. 7. This Court has taken into consideration the fact that the other co-accused person, namely, Badal Ganjhu @ Badal Bhogta @ Bhumar @ Vishal Ji; Ajit Soren have already been granted bail by the co-ordinate Bench of this Court in B.A. No. 1305 of 2025 dated 04.08.2025 and B.A. No. 2399 of 2025 dated18.08.2025 respectively and the case of the present petitioner falls on same footing, which has not been disputed by learned APP appearing for the State and, as such, considering the issue of parity, this Court is of the view that the present application deserves to be allowed. 2026:JHHC:9198 Page | 3 8. 2026:JHHC:9198 Page | 3 8. Accordingly, the instant bail application stands allowed. 9. In consequence thereof, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge, VIII, Hazaribag in connection with Barkagaon P.S. Case No. 65 of 2024 with the condition that the petitioner shall co-operate in the trial and shall not absent himself on the date fixed without any cogent cause.
