JUSTICE LALITHA KANNEGANTI - 4 - HC-KAR NC: 2026:KHC:34274 WP No. 19472 of 2026 ORAL ORDER The present writ petition is filed seeking the following prayer: “Wherefore for the reasons stated in the petition and its grounds the petitioner humbly prayed that the Hon'ble High Court of Karnataka may be pleased to pass order to issue a Writ particularly in the nature of writ of MANDAMUS, 1. To direct the trial court to expedite the Final decree proceedings bearing F.D.P No.94/2011 and dispose of the case on day-to-day basis by conducting the sale of the suit schedule property through public auction as per the Hon’ble High Court order passed in W.P 30859/2019 C/w W.P.No.31693-31695/2019 dated 24/02/2020 Annexure C and another W.P No.21709/2021 dated 08/07/2022 Annexure H in any event within the period of one (1) month/30 days from the date of said order. 2. To direct the trial court to vacate all the occupants of the suit schedule property as per the order dated 16-12-2025 passed by the trial court in F.D.P No.94/2011 as Annexure J, thereby connecting execution case bearing Ex.Pet.No.254/2026 as Annexure-K along with F.D.P proceedings Annexure J, which is filed with respect to above order and dispose of the execution petition in accordance with law in any event within the period of one (1) month/30 days from the date of the order passed by this Hon’ble Court. - 5 - HC-KAR NC: 2026:KHC:34274 WP No. 19472 of 2026 3. To pass such other orders as deemed fit in the circumstances of the case, in the interest of justice and equity.” 2. It is submitted that the FDA proceedings of 2011 are pending, this Court has called for a report from the concerned Court. It is submitted that on 19.06.2026, the Court has appointed a Court Commissioner on the request of the parties. The matter is posted on 10.07.2026 to file memo of instructions as a last chance, to carry out the Court Commissioner's work to auction the scheduled property. It is stated that, in view of the filing of several applications and the non-co-operation of the parties to the petition, the petition could not be disposed of. 3. Learned counsel for the petitioner submits that the FDP is of the year 2011, that the matter is being adjourned at the behest of the respondents, and that there may be direction to the Executing Court to dispose of the FDP as expeditiously as possible. 4. Considering the submission of the learned counsel for the petitioner and looking at the fact that this is the FDP of - 6 - HC-KAR NC: 2026:KHC:34274 WP No. 19472 of 2026 the year 2011, the Court deems it appropriate to pass the following: ORDER i. Accordingly, the writ petition is disposed of directing the Executing Court to dispose of the pending FDP proceedings within an outer limit of four months from the date of receipt of the copy of the order. ii.
