1. P L NARASIMHA RAO Counsel for the Respondent(S):
1. GP FOR INDUSTRIES COMMERCE The Court made the following order:
Heard Sri P.L.Narasimha Rao, learned counsel for the petitioners and Smt. Sudeepthi Potluri, learned Assistant Government Pleader for Mines and Geology appearing for the respondents. 2. The grievance of the petitioners is that the 3rd respondent has issued a show-cause notice dated 28.11.2025 proposing to levy seigniorage, DMF, MERIT and penalty of Rs.1,13,79,000/-. 3. In reply to the said show-cause notice dated 28.11.2025, the petitioners submitted their explanation on 14.12.2025. In the said reply, the petitioners requested the respondents for furnishing of the following documents: a) Detailed Inspection Report of the Mines & Geology Department; b) Orders or instructions issued by the Director of Mines & Geology, Ibrahimpatnam; c) Vigilance & Enforcement reports, including technical observations and volume calculations; and d) Panchanama/Mediatornama and any other field documentation prepared during inspection. 3
4. The apprehension of the petitioners is that the respondents are proposing to pass final orders without considering the objections of the petitioners and without supplying the documents relied upon by the respondents. 5. Today, when the matter is taken up for consideration, Smt. Sudeepthi Potluri, learned Assistant Government Pleader for Mines and Geology appearing for the respondents has placed before the Court a copy of the written instructions received from the 3rd respondent.
A perusal of the same would reflect that pursuant to the show-cause notice dated 28.11.2025, the reply submitted by the petitioner on 14.12.2025 and the petitioner have been received by the Department. However, no final orders have been passed so far. 6. Having regard to the above, this Court deems it appropriate to dispose of the writ petition with a direction to the 3rd respondent to pass orders after considering the objections submitted to the show-cause notice. Needless to observe that before passing final orders, the 3rd respondent shall furnish the documents requested by the petitioner in the reply dated 14.12.2025, within two weeks from the date of receipt of the copy of this order. 7. The petitioners are granted liberty to file additional objections, if any, after the supply of the following material: a) Detailed Inspection Report of the Mines & Geology Department;
4
b) Orders or instructions issued by the Director of Mines & Geology, Ibrahimpatnam; c) Vigilance & Enforcement reports, including technical observations and volume calculations; and d) Panchanama/Mediatornama and any other field documentation prepared during inspection. 8. After the filing of such additional objections, the respondents shall pass final orders pursuant to the show-cause notice dated 28.11.2025 within a period of eight weeks from the date of the objections of petitioner, if any. 9. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. As a sequel, all pending miscellaneous applications shall stand closed. ______________________________ JUSTICE KIRANMAYEE MANDAVA Date: 05.01.2026 BSK
