1. Petitioner complains of violation of the order dated December 17, 2015.
2. Operative part of such order is as follows:-
“Therefore, the order of the learned Trial Court is set aside and the State is directed to pay interest @ 9% p.a. to the writ petitioner from the day when the money was payable till the day when the money was in fact paid. Such payment should be made within six weeks from date. The State shall be at liberty to recover the money on account of interest payable to the writ petitioner pursuant to this
order from the erring officials of the concerned District Primary School Council in accordance with law.”
3. Despite repeated requests for providing the exact date on which, the money became payable to the petitioner and the date when money was actually paid, learned advocate appearing for the petitioner is
2 unable to do so. She seeks time to find out the exact date.
4. Since on the basis of materials made available to us we are not in a position to arrive at a definite finding that there was any delay on the part of the respondents in payment in terms of order dated December 17, 2015, we do not find it appropriate to invoke jurisdiction under Article 215 of the Constitution of India or of the Contempt of Courts Act, 1971.
5. CPAN/1653/2016 is disposed of without any
