2 22.7.2026 1) By way of this petition, the petitioner has sought following reliefs:- 10.1 That this Hon'ble Court may kindly be pleased to
direct
the
respondents
authority promotion/samayojan to the petitioner from the post of give benefit to Attendant (Contingency paid) to Attendant (Regular Establishment) as per
"Chhattisgarh Veterinary Services Class IV Recruitment Rules 2010" due to completion of service tenure of 5 years of the petitioner with the retrospective effect in lieu of his promotional vacant posts, in the interest of the justice. 10.2 That, this this Hon'ble Court may kindly be pleased to direct the respondents authority to consider for posting at fill-up option/sought place, because in that option place which is choose by the petitioner are vacant of his absorption post i.e. regular Attendant, in the interest of the justice. 10.3 That, this this Hon'ble Court may kindly be pleased to direct the respondents authority to consider and decide application dated 31.08.2021 submitted by the petitioner, in the interest of the justice. 10.4 That this Hon'ble Court may kindly be pleased to direct the concerned respondent authority to immediate held and convey the District Label DPC to fulfill many vacant post of Attendant (Regular), in the interest of the justice. 10.5 That, any other relief which the Hon'ble Court may deemed fit and proper also be granted to the petitioners, in the interest of justice.
2) Learned counsel for the petitioner submits initially petitioner was appointed to the post of Attendant (Contingency Paid) under respondent No. 1 vide order dated 28.1.2013 and Deputy Director, Veterinary Services, Janjgir Champa issued gradation list of class- IV employees wherein name of petitioner appeared at S. No. 46 in column of Attendant (Contingency Paid). He further submits that
3 23 Attendants (Regular Establishment) have been promoted to the Class-III Executive Category State Cadre but till date, name of petitioner has not been considered for absorption to the post of Attendant (Regular Establishment). He contends that the order dated 11.5.2026 passed by Deputy Director, Veterinary Services, Janjgir Champa reveals that six posts of Attendant under the regular Class-IV establishment are lying vacant therefore a direction may be issued to the respondent authorities to consider the name of petitioner for absorption against the vacant and sanctioned post of Attendant (Regular Establishment). 3) On the other hand, learned State counsel submits that name of petitioner appears at S. No. 46 in gradation list and his name would considered as per his usual turn therefore this petition is misconceived and liable to be dismissed. 4) Heard. 5) Having considered the fact that six posts of Attendant under regular Class-IV establishment are lying vacant as per order dated 11.5.2026 which has been annexed along with the rejoinder, this petition is hereby being disposed reserving liberty in favor of the petitioner to prefer a detailed representation within period of 30 days before the respondents No. 2 and 3, who in turn are directed to consider the claim of petitioner strictly in accordance with law keeping in mind the order dated 11.5.2026 which describes the vacancies available in the Class-IV establishment of respondent-
4 department as on 1.4.2026. 6) It is expected that the authority(s) concerned shall take appropriate decision by way of a speaking order preferably within a period of 120 days from the date of receipt of copy of such representation. 7) With the aforesaid direction, this writ petition stands disposed.
