The petitioner who is the Pradhan of Dhoradaha –II Gram Panchayat has assailed the no confidence motion submitted by the private respondents/members of the Panchayat on the ground that the notice of meeting has been issued by the Prescribed Authority beyond five working days from receipt of the motion, in contravention of Section 12(2) of the West Bengal Panchayat Act, 1973. Learned counsel for the private respondents produces the copy of the motion which demonstrates that the motion was received by the Prescribed Authority on June 30, 2026. Therefore, the meeting was convened by the Prescribed Authority within five working days of receipt of the motion and is in conformity with Section 12(2) of the Act of 1973. The writ petition is devoid of merit and is accordingly dismissed. There shall, however, be no order as to costs.
