THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA CRIMINAL PETITION NO: 91/2026
ORDER:
The instant Criminal Petition under Section 482 of the Code of Criminal Procedure, 1973 (for short 8Cr.P.C)/under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 8BNSS9) has been filed by the Petitioner, seeking to modify/relax the condition of imposing of Rs.20,00,000/- towards bank guarantee for release of vehicle passed in Crl.M.P.No.830 of 2024 (Crime No.31 of 2024 of IV Town Police Station) on the file of I Additional District & Sessions Judge-cum-Special Judge for Trial of Offences under NDPS Act, Visakhapatnam.
2. Heard Sri Kakumanu Joji Amrutha Raju, learned Counsel for the Petitioner and Mrs.K.Priyanka Lakshmi, learned Assistant Public Prosecutor on behalf of the State.
3.
Learned counsel for the petitioner would submit that the petitioner who is the owner of the vehicle i.e., Car bearing No. AP 39 NR 2446 has filed Crl.M.P.No.1030 of 2025 before the I Additional District & Sessions Judge- cum-Special Judge for Trial of Offences under NDPS Act, Visakhapatnam seeking interim custody of the vehicle which was allowed on a condition to furnish the Bank guarantee for Rs.20,00,000/-. The petitioner could not afford to furnish the same due to her financial constraints. Learned counsel for the petitioner would submit that modifying the said condition is necessary in this matter.
3
4. Learned Assistant Public Prosecutor would submit that the Court may pass appropriate orders.
5. Considering the submissions made, as can be seen from the order passed by the learned Special Judge, the petitioner has been directed to furnish a bank guarantee for Rs.20,00,000/- for which, the petitioner could not afford. In that view of the matter, it is apposite to dispose of the petition by modifying the condition to the effect that 8the petitioner shall furnish bank guarantee for Rs.10,00,000/-9 instead of Rs.20,00,000/-, as was ordered earlier and the rest of the conditions imposed by the learned Special Judge shall remain unaltered.
