23/03/2026 D/L – 32 Court No.6 S. Kundu Rejected IN THE HIGH COURT AT CALCUTTA CIRCUIT BENCH AT JALPAIGURI
CRM (A) 180 of 2026
In Re: An application for anticipatory bail under Section 482 of the BNSS, 2023. In connection with Tufanganj P.S case no. 95 of 2026 dated 13/02/2026 under sections 126(2)/115(2)/117(2)/118(2)/109/351(2)/3(5) of the BNS. In the matter of: Abhinandan Barman & Ors. ...Petitioners. Mr. Satarudriya Mukherjee Ms. Tannu Agarwal …for the petitioners. Mr. Tapan Bhattacharyya Mr. Chattu Roy …for the State.
1. Learned counsel appearing for the petitioners submits as follows. The petitioners have been falsely implicated in this case. More particularly, the names of the petitioner nos. 5 and 6 seemed to have been added in the body of the complaint subsequently, however, before registration of the FIR. There is no specific involvement of the said petitioners mentioned in the FIR.
2. Learned counsel appearing for the State strongly opposes the prayer for anticipatory bail. He refers to the two injury reports, one of which shows fracture on the left ulna.
2
3. It is the prosecution case that the petitioners assaulted one of the victims. When the other victim came and pleaded with them to stop, the said assailants also assaulted the said victim and caused fracture injury.
4. Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case to grant anticipatory bail to the petitioners.
5. Accordingly, the application for anticipatory bail is rejected.
