1. Affidavit-of-service filed on behalf of the petitioner is taken on record.
2. Learned advocate representing the petitioner submits that petitioner is the owner of an agricultural land but peaceful possession of the said land is being disturbed by respondent nos.7 & 8.
3. Prayer is made in this writ petition thereby directing the concerned police authorities to take steps which would preserve right of the petitioner to enjoy peaceful possession of the said land in question.
4. Respondent nos.7 & 8 are represented by learned advocate who has disputed the contention made on behalf of the petitioner. It is also submitted that the land in question is mortgaged to a third party.
5. State respondents are represented by learned advocates.
6. From the submissions made on behalf of the parties, Court finds that right of the petitioner to enjoy
2 possession of the agricultural land in question needs to be decided by appropriate forum; police authority is not the appropriate authority to decide the same.
7. Hence, Court is not inclined to interfere with this writ petition and same stands dismissed.
8. However, this order shall not preclude the petitioner to take steps, in accordance with law.
9. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
