2. The present petition has been filed by the petitioner with the following prayer:
“(i) Allow this petition and issue an order quashing First Information Report No. 0451 of 2026 registered at Police Station Surajpur, District Surajpur (C.G.) against the petitioner, along with all consequential criminal proceedings arising out of the said complaint, to secure the ends of justice. (ii) Any other relief/reliefs which this Hon’ble Court may deem fit and proper in the facts and circumstances of the case, in the interest of justice.”
3. Upon a careful perusal of the prayer clause contained in the present petition, this Court finds that the petition has been drafted with a defective and incomplete prayer. The prayer, as framed, is vague and sketchy, inasmuch as it neither discloses the date of registration of the impugned FIR nor specifies the offences alleged against the petitioner. In the absence of a proper and specific prayer, this Court is not inclined to entertain the petition in its present form. At this stage, learned counsel appearing for the petitioner prays for permission to withdraw the present petition with liberty to file a fresh petition incorporating an appropriate, complete and properly drafted prayer. 4. Learned State Counsel has no objection to the aforesaid request. 5.
In view of the submission made by learned counsel for the petitioner, the present petition is dismissed as withdrawn with liberty
3 to file a fresh petition, subject to the petitioner depositing costs of Rs.2000/- before the Registry of this Court. The receipt evidencing such deposit shall be filed along with the fresh petition, if any. The amount so deposited shall be remitted to the Government Special School for Visually Handicapped Boys and Girls, Jashpur (C.G.). 6. Certified copies of the documents annexed to the petition, if any, may be returned to learned counsel for the petitioner after retaining photocopies thereof on record.
