…...... 05 /09.10.2026: This bail application has been filed by the petitioner under Sections 483 & 484 of BNSS, 2023 wherein, prayer has been made for grant of bail as he is in custody for allegedly committing offence punishable under Sections 126(2), 115, 109, 3(5) of the Bharatiya Nyaya Sanhita (Section 103 of the BNS was later on added to the FIR vide order dated 06.09.2025). 2. Heard, learned counsel for the petitioner, learned counsel for the State and have also gone through the impugned order. 3. Learned APP opposes the prayer for bail. 4. The petitioner renews his prayer for grant of bail. Earlier his prayer for bail was rejected on 12.03.2026 in B.A. No. 11579 of 2025 with a liberty to renew his prayer for grant of bail after examination of Amit Sharma who is claimed to be an eye witness. Now Amit Sharma has already been examined and his deposition has been filed. 5. It is the case of the prosecution that as the deceased and Amit Sharma being friends, they were in a Bar and at night when they were leaving some altercation took place with the

petitioner and others. It is alleged that after some time this petitioner and others again came in a car and thereafter with hockey stick and sticks assaulted both the deceased and Amit Sharma, as a result of which the deceased sustained head injury and later on died. 6. Since Amit Sharma who is an eye witness has already been examined and there is no chance of tampering the evidence of Amit Sharma and the fact that the petitioner is in custody since 10.07.2025, I am inclined to grant bail to the petitioner. 7.
Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-IV, Jamshedpur in connection with S.T. Case No. 45 of 2026 arising out of Bistupur P.S. Case No. 111 of 2025, corresponding to G.R. Case No. 1143 of 2025 subject to the condition that one of the bailors should be a close relative of the petitioner and the petitioner shall appear and mark his attendance before the concerned Trial Court once in a month till conclusion of the trial. 8. Accordingly, this bail application is allowed. (ANANDA SEN, J.) 09.10.2026 Tanuj/CP-3 Uploaded on 09.10.2026
