This is the First bail application filed under Section 483 of the Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail to the applicants arrested in connection with Crime No. 192/2025 registered at Police Station – Bhilai Nagar, District – Durg (C.G.) for the offence punishable under Section 109(1), 296, 115(2), 351(3), 118(1), 191(2), 191(3), 190 and 333 of the BNS and Section 25 and 27 of the Arms Act. 2. Case of the prosecution, in brief, is that on the night of 05.05.2025 at about 10:30 PM, the applicant Lingraj, along with his 4-5 companions, all armed with sharp knives, forcibly entered into the house of complainant. They allegedly dragged the victim i.e. Complainant's son, who was then sleeping on the bed inside his RAJSHEKHAR SONI Digitally signed by RAJSHEKHAR SONI 2 house by his hair and took him out onto the street & all of them saying obscene abuses as well as death threat to victim. It is further alleged that the applicant Lingraj along with other co-accused, assaulted the injured persons, namely Pranshu and his friend Jassu by punching them and striking them with a sharp-edged knife on their head and various other parts of the body. The dispute was eventually pacified through the intervention of the complainant's husband. Upon the gathering off crowd of local residents, Lingraj and his companions fled away from spot. That on the completion of the investigation, the Police had filed the Chargesheet before the trial Court. Hence, this application. 3. Learned counsel appearing for the applicants submits that the applicants are innocent and has been falsely implicated in the present case and the charge-sheet has been filed in this case. It is submitted that the co-accused Vinay Baghel and Devendra Singh @ Somu Sardar were granted bail by this Court vide orders dated 19.02.2026 and 29.04.2026 passed in MCRC Nos.1752/2026 and 3869/2026. It is submitted that the applicants are in jail since 18.06.2025, and the conclusion of the trial shall take quite long time. Therefore, he prays for grant of bail. 4. On the other hand, learned State counsel, opposes the bail application and submits that the applicant along with the co-accused is said to have assaulted the injured with knife, and as per the memorandum statement of the said co-accused persons, they had assaulted the injured with hands and fists, and the role of assaulted through knife is actually attributed to the present applicant, due to 3 which the injured has suffered multiple lacerated wounds and incise wounds also on his person and he has undergone a surgery also, and the injuries were found to be grievous in nature. As such, the bail application deserves to be rejected. 5. I have heard learned counsel for the parties and perused the case diary. 6. Taking into consideration the facts and circumstances of the case and also considering the fact that the applicant along with the co- accused is said to have assaulted the injured with knife, and as per the memorandum statement of the said co-accused persons, they had assaulted the injured with hands and fists, and the role of assaulted through knife is actually attributed to the present applicant, due to which the injured has suffered multiple lacerated wounds and incise wounds also on his person and he has undergone a surgery also, and the injuries were found to be grievous in nature, therefore, this Court is of the opinion that it is not a fit case to enlarge the applicants on regular bail. 7. Accordingly, this bail application of applicant – Lingraj Mahanand, involved in Crime No. 192/2025 registered at Police Station – Bhilai Nagar, District – Durg (C.G.) for the offence punishable under Section 109(1), 296, 115(2), 351(3), 118(1), 191(2), 191(3), 190 and 333 of the BNS and Section 25 and 27 of the Arms Act, is rejected at this stage. 8. Needless to say that the trial Court concerned is at liberty to 4 proceed and conclude the trial expeditiously. 9.
