HARI HARANADHA SARMA CRIMINAL PETITION NO: 4610/2026 The Court made the following Order: The Criminal Petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to set aside the docket order dated 25.05.2026 passed in Crl.M.P No.290 of 2026 in C.C No.1499 of 2023 on the file of the learned Chief Metropolitan Magistrate, Vijayawada and for a consequential relief to set aside the non-bailable warrant issued against the petitioner/accused No.1. 2. Heard Sri K.Ravi Teja, learned Counsel for the petitioner and learned Assistant Public Prosecutor representing the respondent-State. 3. The Petitioner/Accused No.1, who is aged about 86 years while invoking Section 72(2) of the BNSS, 2023 filed a petition vide Crl.M.P No.290 of 2026 seeking recall of Non-Bailable Warrant issued against her and the same was dismissed by the Chief Metropolitan Magistrate, Vijayawada on 25.05.2026. Aggrieved thereby, the Petitioner/Accused No.1 is before this Court. 4. Learned counsel for the petitioner would submit that the petitioner is aged about 86 years and she is ready to abide any conditions as imposed by this Court. 5. Upon considering the facts and circumstances of the case, particularly the age of the petitioner and that she is a woman, the prayer is found convincing, however, this Criminal Petition is allowed on the condition that the 4 Petitioner/Accused No.1 is directed to appear before the learned Chief Metropolitan Magistrate, Vijayawada within two (02) weeks and shall execute bail bonds of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties for the like sum each to the satisfaction of the learned Chief Metropolitan Magistrate, Vijayawada where upon NBW’s shall stand recalled. __________________________________ JUSTICE A.
