Learned advocate appearing for the petitioner submits that the petitioner was arrested for alleged recovery of 125 bottles of phensedyl and the petitioner is in custody since 08.03.2024. Earlier, there was a submission on behalf of the State when 10 witnesses were examined out of the 11 witnesses and the prosecution intended to complete the evidence by 6th and 7th February, 2026. Learned advocate appearing for the petitioner contest the issue that the single witness which was left till date has not been examined. Having considered that the petitioner is in custody for two years four months and the trial is at an advance stage, I direct the learned trial Court that if for reasons beyond control, the evidence of 2 the witnesses no.11 of the prosecution is not completed within a period of three months from the date of communication of this order, the learned trial Court would release the petitioner on bail. At this stage, the prayer for bail of the petitioner is rejected. However, learned trial Court would adhere to the directions passed above. With the aforesaid directions, CRM (NDPS) 812 of 2026 is disposed of. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
