Learned advocate appearing for the petitioner submits that the petitioner is similarly placed as the other accused person who has been granted bail in CRM (NDPS)1010 of 2026. On the other hand, learned Additional Public Prosecutor appearing on behalf of the State opposes the prayer for bail. So far as the issue relating to parity in the present case is concerned with that to one of the considerations while granting bail but as submitted on behalf of the State there are 17 other cases against the present petitioner and the present petitioner has been convicted in Berhampore Police Station Case No.663 of 2024. Having considered that the petitioner while on bail in 2 appeal has committed again alleged offence, I am not inclined to release the petitioner on bail. As such, the prayer for bail in CRM(NDPS)1012 of 2026 is dismissed. Learned Additional Public Prosecutor has submitted that the prosecution may reduce the number of witnesses. Petitioner is in custody already for 1 year 3 months. Learned special court would put in efforts so that within a year from the date of communication of this order, rest of the witnesses are concluded. Memo of Evidence submitted by the State be kept with the record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
