JUSTICE P SREE SUDHA ORAL ORDER This transfer petition is filed by the petitioner –wife seeking transfer of M.C.No.101/2024 filed by the husband for restitution of conjugal rights before the Principal Senior Civil Judge and CJM, Ramanagara. 2. It is stated that petitioner-wife is residing at Mysuru and she also filed Crl.Misc.No.110/2010 for maintenance and filed C.Misc.No.8/2021 under Section 12 of the Protection of Women from Domestic Violence Act, 2005. Interim maintenance of Rs.8,000/- per month was - 3 - HC-KAR NC: 2026:KHC:34880 CP No. 120 of 2025 granted. She is staying with her parents at Mysuru and she is not working and earning. 3. Learned counsel for the respondent stated that the respondent is an activist and is residing in Ramanagara. The distance between Ramanagara and Mysuru is 95 Kms. Learned counsel for the respondent stated that husband is ready to incur the traveling expenses of the petitioner. But learned counsel for the petitioner stated that so far the respondent had not paid any maintenance amount which is granted by the Court. It is further stated that he has filed restitution of conjugal rights after four years as a counterblast to the other cases filed by the wife. 4. Considering the arguments of both the counsel this Court deems it fit to transfer M.C.No.101/2024 pending on the file of Principal Senior Civil Judge and CJM at Ramanagara filed by the respondent to the Principal - 4 - HC-KAR NC: 2026:KHC:34880 CP No. 120 of 2025 Judge, Family Court at Mysuru to try along with the other cases filed by the petitioner in the same Court. 5. Respondent is at liberty to file affidavit and he can be cross-examined through Commissioner or video conferencing. Accordingly, Civil Petition is allowed.
