This is the first bail application filed under Section 483 of the BNSS, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No.415/2025, registered at Police Station- Akaltara, District- Janjgir-Champa (CG) for the offence punishable under Sections 137(2), 64(2)(m), 87, 65(1) of VASANT KUMAR Digitally signed by VASANT KUMAR Date: 2026.07.22 17:02:51 +0530
2 BNS and Section 6 of POCSO Act. 2. The prosecution case is that 13-year-9-month-old victim went missing from her house on 28.08.2025, whereupon her grandmother lodged a report on 29.08.2025. During investigation, the victim was recovered from the custody of the applicant at Rajendra Nagar, Urla. After recording the victim's statement and completing the investigation, the police filed the charge-sheet against the applicant before the competent Court. 3. Learned counsel for the applicant contended that the applicant has not committed any offence and has been falsely implicated in the said case. She further contended that the medical report of the prosecutrix does not support the case of prosecution and the applicant is in jail since 07.09.2025, and the trial will take considerable time for its conclusion, therefore, the applicant may be released on bail. 4. Learned State counsel opposes the submission made by learned counsel for the applicant and would submit that at the time of incident, age of the victim was 13 years and 09 months. She further contended that the applicant had abducted the minor victim from her lawful guardianship and the victim and her mother supported the case of prosecution, therefore, the applicant may not be released on bail. 3
5. Pursuant to order dated 22.06.2026, victim and her mother appeared before this Court through virtual mode from the DLSA- Janjgir Champa (C.G.). On being asked, they raised objection for grant of bail to the applicant. Their statements are taken on record. 6.
I have heard learned counsel for the parties. 7. Considering the facts and circumstances of the case and further considering the material available on record, this Court is not inclined to grant bail to the applicant. 8. Accordingly, the bail application of the applicant stands rejected. 9. Office is directed to send a certified copy of this order to the trial Court concerned for information.
