Learned advocate appearing for the petitioner submits that the approver has been granted and the present petitioner is in custody for four years two months. Petitioner submits that there is no possibility of the trial being concluded in near future as prosecution has relied upon 70 witnesses and till date only 10 witnesses have been examined. Learned advocate appearing for the State opposes the prayer for bail and highlights that this is a double murder case at the time of committing robbery. It has also been submitted that the State has on assessment reduced the number of witnesses to 25, as such steps would be taken to conclude the trial at the earliest. Having regard to the submissions advanced by the learned advocate for the State, I direct the State to conclude rest of the 15 witnesses within a period of six months.
2 Learned trial Court would not allow any unnecessary adjournment to either of the parties and proceed with the trial of the case in spite of resolution of the local bar. If a witness is present, in that case the said witness be completed on the same date and the same be fixed for another date only under special circumstances be be recorded by the learned trial Court. With the aforesaid observations CRM (M) 1202 of 2026 is dismissed at this stage. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
