Order No.02
Date: 05.10.2026
1. The present writ petition has filed seeking issuance of a direction upon the Settlement Officer, Santhal Pargana Dumka (the respondent no.4) to make necessary corrections in the records of land appertaining to Old Khata No.39, New Khata Nos.10/39 and 7/29, Plot No.912, situated at Mouza- Pachhiyari, Thana-Jasidih, District-Deoghar, measuring an area of about 2.72 acres restoring the name of Jogendra Nath Dubey (late father of the petitioner) in the record of the said land pursuant to the order dated 9th February, 2026 passed by a co-ordinate Bench of this Court in W.P.(C) No.3597 of 2018.
2. Heard learned counsel for the parties.
3. It appears that the petitioner was an intervenor/respondent no.24 in W.P.(C) No. 3597 of 2018, preferred by Sanjeev Kumar Dubey and Gunadhar Dubey. The said writ petition was
disposed of by a co-ordinate Bench of this Court vide order
Neutral Citation No. (2026:JHHC:29644)
dated 9th February, 2026, which was subsequently modified vide order dated 19th June, 2026, passed in C.M.P. No. 336 of 2026 correcting the name of the respondent no.24 i.e., the present petitioner. In the order dated 9th February, 2026, the co-ordinate Bench held that a long-standing Jamabandi cannot be cancelled in a summary proceeding and, accordingly, allowed the said writ petition by setting aside the impugned
order dated 15th February, 2018.
4. Since W.P.(C) No. 3597 of 2018 in which the present petitioner was respondent no.24, was allowed by a co-ordinate Bench of this Court and the land which was the subject matter of the said writ petition, is also the subject matter of the present one, this Court is of the view that no further order can be passed with regard to the said land. The prayer made in the present writ petition is, completely, misconceived.
5. Accordingly, the present writ petition is dismissed.
6. The petitioner is, however, at liberty to work out alternative remedies as available under law for redressal of his subsisting grievance.
