Heard Mr. Rahul Mishra, learned counsel for the petitioner. Also heard Mr. Shashank Thakur, learned Addl. Advocate General, appearing for the State-respondents. 2. The present writ petition has been filed by the petitioner seeking the following relief(s): “10.1 That, this Hon'ble Court may kindly be pleased to set aside the impugned order dated 04.05.2026 (ΑΝΝEXURE P/1) passed by Respondent No. 4, whereby the Petitioner's contract in respect of Package No. CG-15-303 under the Pradhan Mantri JANMAN Yojana, Contract No. 336/PIU/2023-2024, has been cancelled. 10.2 That, this Hon'ble Court may kindly be pleased to set aside the fresh Notice Inviting Tender (NIT) bearing No. 1150 Cons./Main./PM- JANMAN/PKG No. CG-15-303, dated 23.06.2026 (ΑNNEXURE P/2), giving one year time to complete the remaining work. 10.3 That, this Hon'ble court may kindly be please to direct the Respondent no. 4 to restore the Petitioner's contract, permit the Petitioner to 3 resume and complete the balance work under Package No. CG-15-303 within period of six- month as per petitioner representation. 10.4 That, this Hon'ble court may kindly be please to direct the Respondent no. 4 to release forthwith the outstanding payment due and payable to the Petitioner for the work already executed by him, along with a reasonable rate of interest. 10.5 That, any other relief or reliefs may also be granted to the petitioner which this Hon'ble court deems fit and proper in the facts and circumstances of the case.” 3. Learned counsel for the petitioner submits that on 24.01.2026 the Respondents revoked the earlier cancellation order dated 14.08.2025 and permitted the Petitioner to complete the remaining work and by the impugned order they could not have canceled the contract again without following due process of law. The delay in execution was due to unavoidable circumstances beyond the Petitioner's control, including non-clearance of the site by the Forest Department, shortage of bitumen and unprecedented rainfall. It is further submitted that vide impugned order dated 04.05.2026 (Annexure-P/1) the respondents have canceled the contract and the petitioner filed his representation dated 25.05.2026 explaining the delay and seeking extension of time 4 which has not been decided by the respondents and they have issued the fresh NIT dated 23.06.2026. The petitioner needs only one month’s further time to complete the balance work. Therefore, it is prayed that the petitioner may be permitted to complete the balance work within a further period of one month only. 4. On the other hand, learned counsel for the respondents submits that the impugned order has been passed on 04.05.2026, however, the present petition has been filed by the petitioner in the month of July, 2026 after issuance of fresh NIT. He further submits that the respondents have already given sufficient time by canceling the earlier order 14.08.2025 on 24.01.2026 and thereby the petitioner was permitted to complete the balance work till 28.02.2026. However, the petitioner failed to complete the work within stipulated time. Thereafter, the impugned order has been passed and fresh NIT has been issued. 5. We have heard learned counsel for the parties and perused the documents annexed with the petition. 6. Considering the submissions made by learned counsel for the parties and the fact that the petitioner was earlier permitted to complete the balance work for the reasons explained by the petitioner to the respondents and the petitioner is again seeking only one month’s further time for completion of remaining work, it would be appropriate to grant one more opportunity to the petitioner for completion of the work. Accordingly, the present writ petition is disposed of quashing the impugned order dated 5 04.05.2026 whereby the contract of the petitioner has been canceled and the petitioner is granted further time of one month, i.e., till 20-08-2026 for completion of concerned remaining work.
