1. Affidavit-of-service filed on behalf of the petitioners is taken on record.
2. Learned advocate representing the petitioners submits inaction on the part of concerned police authorities in taking steps based on the complaint lodged. However, it is submitted that as yet no FIR has been drawn up.
3. Prayer is made in this writ petition directing the police authorities to take necessary steps in consideration of the complaint lodged by the petitioners.
4. Mr. Roy, learned Government Pleader representing the State respondents submits that offence reported to the concerned police authorities is not cognizable offence requiring drawing up of FIR.
5. If petitioners are aggrieved by inaction on the part of the concerned police authorities since complaint of the petitioners is not transformed into an FIR, in that event petitioners are required to approach jurisdictional Magistrate under Section 175(3) of BNSS, 2023.
6. In this regard, reliance is placed on the judgment of the Hon’ble Supreme Court, reported in (2007) 6 SCC 171 (Aleque Padamsee & Ors. –vs. Union of India & Ors.).
7. Hence, writ petition is not entertained and stands dismissed.
8. However, this order shall not preclude the petitioners to approach the jurisdictional Magistrate, in pursuit of remedy.
