Accused Nos.1, 2 and 4 in Crime No.125/2026 registered by Shikaripura Rural Police Station, Shivamooga, for the offences punishable under Sections 118(1), 74, 329(4), 351(3) and 3(5) of BNS, 2023, are before this Court in this petition filed under Section 482 of BNSS, 2023, seeking anticipatory bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.125/2026 was registered by Shikaripura Rural Police Station, Shivamogga, for the aforesaid offences against the petitioners herein and another based on the first information dated 20.04.2026 received from Murthy Naik. Apprehending arrest in the said case, petitioners had filed Crl.Misc.No.419/2026, which was rejected on 16.05.2026. Therefore, they are before this Court. - 3 - HC-KAR NC: 2026:KHC:35725 CRL.P No. 8112 of 2026 4. Perusal of the material on record would go to show that there is some civil dispute between the two parties and in the alleged incident that had taken place on 18.04.2026, allegation of assaulting the injured victims with an iron rod is found as against accused No.1-Lohith. Injured victim Savitha Bai has suffered grievous injuries on her head as a result of assault made by accused No.1 with iron rod. The other injured victims have suffered only simply injuries in the incident in question. Accused Nos.2 and 4 are the parents of accused No.1 and there is no allegation as against them about assaulting the injured victims with any deadly weapons, which has resulted in causing grievous injures. Under the circumstances, I am of the opinion that the prayer made by accused Nos.2 and 4/petitioners No.2 and 3 for grant of anticipatory bail can be granted, while prayer made by accused No.1 needs to be rejected. Accordingly, the following:- ORDER (i) The petition is partly allowed. The petition filed by accused Nos.2 and 4/petitioner Nos.2 and 3 is allowed. The petition insofar as it relates to accused No.1/petitioner No.1 is dismissed. - 4 - HC-KAR NC: 2026:KHC:35725 CRL.P No. 8112 of 2026 (ii) The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner Nos.2 and 3/accused Nos.2 and 4, in the event of their arrest in Crime No.125/2026 registered by Shikaripura Rural Police Station, Shivamooga, for the offences punishable under Sections 118(1), 74, 329(4), 351(3) and 3(5) of BNS, 2023, subject to the following conditions: 1. The accused Nos.2 and 4/petitioner Nos.2 and 3 shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- each with two sureties for the likesum to the satisfaction of the investigating officer. 2. Accused Nos.2 and 4/petitioner Nos.2 and 3 shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. - 5 - HC-KAR NC: 2026:KHC:35725 CRL.P No. 8112 of 2026 3. Accused Nos.2 and 4/petitioner Nos.2 and 3 shall not tamper with the prosecution witnesses and they shall co-operate with the police for investigation and appear before them whenever called upon. 4.
