By the present petition, the petitioner is challenging the impugned order dated 09/06/2025, by which, the petitioner has been transferred from Government Higher Secondary School, Pandripani, Block Charama, District Kanker to Government Middle School, Bhairamganj, Block Jagdalpur, District Bastar. 2. Learned counsel for petitioner submits that the petitioner who is working as Lecturer (History) posted at Government Higher Secondary School, Pandripani, Block Charama, District Kanker has been transferred to Government Middle School, Bhairamganj, Block Jagdalpur, District Bastar. Initially, the petitioner had filed writ petition bearing WPS No. 6709/2025 which was disposed of permitting the petitioner to submit representation before the Committee. Thereafter, the petitioner submitted representation before the Committee, which came to be rejected by order dated 14.08.2025. Learned counsel further submits that the petitioner went to join the transferred place of posting, however, it revealed that the post of Lecturer (History) is not vacant at Transferred place. 3. Learned State counsel submits that in view of the grounds raised in this petition and in respect of the post of Lecturer (History) is not vacant in the school where the petitioner has transferred, he may submit fresh representation before respondent No.3 and if such representation is submitted, it will be considered in accordance with law. 4. On the last date of hearing, there was direction to the State counsel to seek instruction whether the post to which the petitioner has been transferred, is lying vacant on the transferred place of posting. 5. In reply, learned State counsel submits that no such post is vacant 3 / 3 presently where the petitioner has been transferred. 6. I have heard learned counsel for the parties, perused the pleadings and documents. 7. On due consideration on the submission of learned counsel for parties, let petitioner submit fresh representation before respondent No.3 and if such representation is submitted, respondent No.3 shall consider and take decision on the representation to be submitted by petitioner within reasonable period. 8. With the aforesaid observation and directions, this writ petition stands disposed off. 9. It is made clear that the impugned transfer order dated 09/06/2025 in respect to the petitioner shall remain stayed till the decision is to be taken on the representation to be submitted by the petitioner.
